We talk about Mr. S Ali case, It’s an easy case in the beginning, as it is for student visa extension and adding to spouse. Student visa extension is not critical, critical part is to add her spouse. Both got married on Skype video call on 18, December 2016 in the presence of families, relatives and close friends and were supervised by MOLANA (celerant) at Mahwish parents’ house in Islamabad.
The MOLANA who supervised the Nikah(marriage), registered it with Arbitration Council who issued the marriage registration certificate. But Immigration officer is not satisfied with it. They said they would not accept this marriage. Mr. S also did great reception party on 14, July 2017, so we explain everything to Immigration officer.
We also told them that Video call marriages are 100% legitimate according to the Muslim Laws of Pakistan and they are normal in practice. According to Muslim law a marriage could be performed by offer and acceptance in the presence of witnesses. However, the registration is necessary under the Muslim family law Ordinance 1961, to secure the family rights of both male and female and they have done that on 14 July 2017, when MR. S came to Pakistan for marriage.
Our difficulties not end here. Next requirement we need to meet is for Mr. S wife bio-metrics. She had done with bio metrics, but due to some technical issue it is not uploaded on Immi websites. The case is again come in dilemma, we have spoken to Immigration Department again and again and sent email but no positive response came earlier, and Mr. S is also worried about her wife, as they want to live together.
But finally, this issue resolved and we got visa of both husband and wife. I really took a sigh of relief after the visa.
