What is a Child Visa?

Australian Child Visas offer various options for sponsors to apply for a visa for their children to join them in Australia. To be eligible to sponsor a child, the parent must be an Australian Citizen, a Permanent resident in Australia, or an eligible New Zealand Citizen. In some cases, the partner of the child’s parent can also become the sponsor. The children eligible for Australian visas are those who are under 18 years old, between 18 and 25 years old and are full-time students and dependent on their parents, or 18 years of age or older and not able to work due to a disability and dependent on their parents.

Child Visa Subclasses

In Australia, there are four different visa options available for children to apply for. These include the Child Visa (Subclass 101) for children outside of Australia, the Child Visa (Subclass 802) for children currently in Australia. The main difference between the Child Visa (Subclass 101) and Child Visa (Subclass 802) is the current location of the child, with the overall process and requirements being the same for both permanent visa options. The Dependent Child Visa (Subclass 445) allows children to stay in Australia with their parents while their parent is on a temporary visa, and the Adoption Visa (Subclass 102) allows parents to bring their adopted child to live with them in Australia. This visa is for those parents who would like to sponsor and have their adopted child living outside Australia to live with them.

Requirements

To apply for a child visa, certain requirements must be met. The requirements for both the Child Visa Subclass 101 and Subclass 802 are the same. Below is a list of the requirements for both Child Visa 101 and Child Visa 802.

The child must be dependent on their parents.

A sponsor must be in place before submitting the application.

The applicant must meet the age requirement.

The applicant must not have any partner or other relationship.

The applicant must meet other basic requirements such as health, character, and the best interest of the child.

The applicant must submit written consent to migrate to Australia.

The application should not have been rejected or refused by DHA on a previous visa application.

The Dependent Child Visa (Subclass 445) is a short-term visa for a child, and the requirements for this visa are not as strict as the other visas. However, the visa will be valid only until the Department of Home Affairs makes a decision on the child’s partner visa application. The length of the visa will depend on the processing time of the application, if the decision is taken within a week, the visa will expire in a week.



Requirements

Be a dependent child of the visa-holding parent.

Be sponsored by the numerator or sponsor of the visa-holding parent.

Must be under 18 years old (if over 18, the child must be financially dependent on the parent).

The child must have consent to travel to Australia.

Other requirements such as health, character, and the best interest of the child must be met.

Adoption Visa is a little bit more complicated than other Child Visas. However, the Requirements are simple in adoption visas (Subclass 102).

Requirements

The child must not be over 18 years of age when adopted.

The child must be under 18 years of age while the application is lodged and until a decision is made.

The child must be overseas when the visa application is submitted.

The child must be in the process of being adopted or adopted by their sponsor parent

The child should be sponsored by an eligible adoptive parent or prospective adoptive parent
