A 16-year-old offshore student visa applicant received a refusal on her Student Visa (Subclass 500) application. Instead of immediately advising the family to start again with a new application, Think Higher reviewed the refusal decision carefully and identified an issue that we believed required the Department of Home Affairs to look at the case again.
What followed was around one month of communication with the Department, during which our team explained the issue, supported our position and requested reconsideration. The Department has now agreed to reconsider the original visa application, which is currently awaiting a fresh decision.
The Student Visa Refusal
The application had been lodged offshore for a minor student seeking to study in Australia.
When the refusal was received, the first step was not simply to accept the outcome. Our team went back through the decision and the application history to understand exactly why the visa had been refused.
During that review, we identified an error in the decision that raised concerns about whether the refusal had been made correctly.
For the family, this was important because a refusal does not always mean the only option is to submit another application. The right next step depends on what happened in the original case and whether there is a genuine basis to challenge or clarify the decision.
Why We Did Not Immediately Recommend a New Application
Reapplying can sometimes be the appropriate option after a student visa refusal, but it was not the approach we wanted to take in this matter without first addressing the problem we had identified.
Starting again would have meant preparing another application, paying further costs and leaving the original decision unchallenged.
Instead, we decided to contact the Department directly and explain why we believed the refusal needed to be reviewed.
Raising the Issue With the Department
The matter was not resolved through a single email. There was ongoing correspondence with the Department over approximately one month.
During that period, our team continued to explain the issue and request that the original application be reconsidered rather than requiring the client to simply lodge again.
The focus throughout the communication was on the problem identified in the refusal decision and why the original application should receive another assessment.
The Department Agreed to Reconsider the Application
After the back-and-forth communication, the Department responded confirming that the application would be reconsidered.
This means the earlier refusal is no longer being treated as the final position on the application and the Department is now undertaking a fresh consideration of the matter.
The student visa has not yet been granted, so it would be incorrect to present this as a visa grant success. The significant outcome is that an offshore application that had already been refused is now back under consideration after the issue was raised with the Department.
Why This Outcome Matters
A visa refusal can feel final, particularly for an offshore applicant. But the correct response to a refusal should always start with understanding the actual reasons behind the decision.
In this case, reviewing the refusal carefully allowed us to identify an issue that justified further communication with the Department.
Rather than moving straight to a new application, we were able to:
- Review the refusal decision in detail
- Identify the issue within the original decision
- Contact the Department and explain our concerns
- Continue correspondence over approximately one month
- Request reconsideration of the existing application
- Obtain confirmation that the Department would assess the application again
The case shows why the reasoning in a refusal letter should be reviewed properly before deciding what to do next.
Reconsideration Does Not Mean a Visa Grant Is Guaranteed
It is important to be clear about where the matter currently stands. The Department has agreed to reconsider the application, but a new decision has not yet been made.
The Department is now reviewing the application again, and a new decision will follow once that process is complete. For that reason, we are not claiming that the visa has been granted or that a positive decision is guaranteed.
The achievement is that the original refusal was successfully brought back before the Department for reconsideration.
What Applicants Can Learn From This Case
Not every student visa refusal will have the same circumstances, and not every refusal can be reconsidered in this way.
However, receiving a refusal should not automatically lead to a decision to reapply without first understanding:
- the exact reason for refusal
- whether the decision accurately reflects the application and evidence
- whether any factual or legal issue appears in the decision
- what review, reconsideration or reapplication options may be available
- whether further action needs to be taken within a particular timeframe
The appropriate strategy depends on the individual case.

Our role in this matter went beyond preparing the original Student Visa application.
After the refusal, we reviewed the decision, identified the issue, communicated directly with the Department and continued to pursue the matter until confirmation was received that the application would be reconsidered.
For the client and her family, that meant they did not have to simply accept the original refusal as the end of the process without the issue being addressed.
The application is now back with the Department for a fresh decision, and we will continue to manage the matter while reconsideration is underway.
